Formalities for selling a used boat, who does what ?

The sale and purchase of a used boat between individuals requires the buyer and the purchaser to complete administrative formalities. They are different for each one and must be carried out in the month which follows the sale.

The seller's obligations

Once you've sold your boat, it's not all over for the seller. There are still a number of administrative formalities to be completed with the relevant authorities. Once again, it's all a question of boat length and engine power.

The declaration of sale must be made within one month of the date of signature. Don't forget to declare the sale of your boat, to avoid being held liable in the event of claims or problems arising after the sale.

Length < 7 m and engine power < 22 HP

Register the sale of your boat with the Délégation à la mer et au littoral. Indicate the new owner (name and address).

Length ? 7 m without motor

Register the sale of your boat with the Délégation à la mer et au littoral, as well as with the customs office in your home port.

Length ? 7 m with motor power ? 22 HP

The procedure is the same as in the first case.

The buyer's obligations

You are now the proud owner of a pleasure boat, and you need to register it. Registration is compulsory for both new and used boats.

This application must be made by the buyer of the boat, and depends on its length (less than, equal to or greater than 7 m) and its horsepower (less than, equal to or greater than 22 hp).

These procedures can be carried out by post (registered mail with acknowledgement of receipt) or directly at your local office.

  • Photocopy of your passport or national identity card.

Length < 7 m and engine power ? 22 HP

Your boat must first be registered under the French flag. As a reminder, the francisation of a boat is the right to sail under the French flag. This act concerns boats with a length ? to 7 m or < to 7 m, but whose engine power exceeds 22 HP.

If you're a member of the European Economic Area (EEA), you'll keep the French flag if you buy a used boat with a French flag. Otherwise, customs will remove the French flag.
